1. Parties and Subject Matter

These Terms of Use ("Terms") govern the terms and conditions relating to the use of the website, software, mobile applications, API services, artificial intelligence-supported solutions and all related services offered by StayLine.

StayLine is a technology platform that enables hotels, accommodation businesses and other commercial enterprises to manage their guest communication processes, track requests, benefit from artificial intelligence-supported services and carry out their operational processes in a digital environment.

All persons who visit the platform, create an account, benefit from the services or access the platform in any way declare that they have read, understood and accepted these Terms of Use.

2. Scope of Services

The services offered by StayLine may include guest communication, WhatsApp Business integration, artificial intelligence-supported message management, request routing systems, translation services, reporting tools, analytics systems and other digital solutions offered by the platform.

StayLine reserves the right to develop, change, expand, narrow or remove certain features of the scope of the services.

It is not guaranteed that all of the services offered through the platform will be included for every user or every subscription package.

3. Account Creation and User Responsibilities

In order to benefit from certain features of the platform, the creation of a user account may be required.

Users accept that the information they provide when creating an account is accurate, current and complete. StayLine is not responsible for consequences arising from incorrect or incomplete information.

Users are obliged to ensure the security of their account information and passwords. Transactions carried out through the account are deemed to have been carried out by the user.

Users are obliged to immediately notify StayLine if they notice that their accounts are being used by unauthorized persons.

4. Lawful and Appropriate Use

Users agree to use the platform in accordance with the applicable legislation, general moral rules and the rights of third parties.

Use of the platform for the following purposes is prohibited:

• Engaging in unlawful activities
• Sending spam or bulk unsolicited messages
• Infringing the rights of third parties
• Spreading malicious software
• Attempting to breach the security of the system
• Making unauthorized access attempts
• Violating Meta Platforms or WhatsApp Business policies
• Processing or sharing personal data unlawfully

StayLine has the right to suspend or terminate a user account if it detects that these provisions have been violated.

5. WhatsApp Business Services

StayLine provides its services through the WhatsApp Business Platform and WhatsApp Cloud API infrastructure offered by Meta Platforms.

When benefiting from WhatsApp services, users are obliged to comply with the current terms of use, commerce policies and other rules published by Meta Platforms.

StayLine is not responsible for consequences that may arise due to restrictions, account closures, access blocks or policy violations applied by Meta Platforms.

6. Artificial Intelligence Services

Some features offered by StayLine may be operated using artificial intelligence technologies.

Responses, translations, suggestions, analyses or classifications generated by artificial intelligence systems are of an auxiliary nature only. These outputs do not constitute definitive information, professional advice or a guarantee.

Users are obliged to carry out the necessary checks before using content generated by artificial intelligence.

StayLine cannot be held responsible for errors, deficiencies or inaccuracies that may occur in content generated by artificial intelligence systems.

7. Intellectual Property Rights

The intellectual and industrial property rights over the StayLine platform, its software, user interfaces, designs, database structures, logos, trademarks, visuals, algorithms, artificial intelligence integrations and all other content belong to StayLine or to the relevant rights holders.

Users are granted only a limited, revocable and non-transferable right of use for the purpose of benefiting from the services.

Users may not copy, reproduce, reverse engineer, attempt to obtain the source code of or use for commercial purposes the platform without the written permission of StayLine.

8. Protection of Personal Data

StayLine carries out its activities relating to the processing of personal data in accordance with the applicable data protection legislation.

Detailed information regarding the processing of personal data is set out in the Privacy Policy and the KVKK Disclosure Notice.

With respect to the guest data processed through the platform, the data controller is the relevant hotel or accommodation business. StayLine acts in the capacity of data processor with respect to this data.

9. Service Continuity and Interruptions

StayLine aims to provide its services at the highest possible level of availability.

Nevertheless, temporary interruptions in services may occur due to maintenance work, updates, problems originating from third-party service providers, internet infrastructure problems, cyber attacks, force majeure or technical malfunctions.

StayLine does not guarantee that the services will be uninterrupted, error-free or continuously accessible.

10. Limitation of Liability

To the extent permitted by the applicable legislation, StayLine cannot be held responsible for direct or indirect damages, data losses, business losses, revenue losses, reputational losses or disputes with third parties arising from the use or inability to use the platform.

In the event that StayLine is held liable for any reason, its liability shall be limited to the service fee paid to StayLine by the relevant user within the last twelve months.

This limitation does not apply in cases of gross negligence or willful misconduct.

11. Suspension and Termination

StayLine may temporarily suspend or completely terminate a user account in cases of violation of these Terms of Use, detection of unlawful use, occurrence of a security risk or violation of the rules of third-party providers.

Users may also terminate their accounts and use of the services at any time.

Termination does not eliminate the rights and obligations of the parties that have accrued up to the date of termination.

12. Changes

StayLine reserves the right to update, change or reorganize these Terms of Use at any time.

The updated text enters into force on the date it is published on the website. Continued use of the platform means that the current terms have been accepted.

13. Applicable Law and Jurisdiction

The law of the Republic of Türkiye shall apply to the interpretation and implementation of these Terms of Use.

The Antalya Courts and Antalya Enforcement Offices shall have exclusive jurisdiction in the resolution of any disputes arising from or connected with these Terms of Use.
